Weenis, when you say the dog should have been confined you are making a judgement call on the law in that area. Where I live your dog does not have to be leashed or confined as long as it stays on your property. Clearly the dog didn't leave the property as the drive way was part of her property. So...

Trespassing is not an issue in the given situation.
Also, it could be argued that the officers entered the dogs restrained area. But as the video tape shows, there's no gate to the property.
